EPA Grants Waiver Allowing Nationwide Summertime E15 Sales

The Environmental Protection Agency (EPA) has announced it will grant emergency waivers allowing the sale of gasoline containing up to 15 percent ethanol (E15) during the summer 2024 driving season.

EPA cited “extreme and unusual fuel supply circumstances” in its decision to justify granting the temporary waiver for this summer. EPA’s emergency fuel waiver will go into effect on May 1 when terminal operators would otherwise no longer be able to sell E15 in the affected regions of the country and will last for the statutory maximum of 20 days. EPA has indicated it is likely to renew the waiver throughout the summer driving season.

Federal law currently prohibits the sale of low-volatility gasoline during the summer months, but EPA has the authority to temporarily waive the requirements in emergency circumstances to address fuel shortages.

EPA’s decision follows a March 7 written request from NATSO for a summertime E15 waiver. NATSO argued that ongoing supply chain issues and geopolitical unrest have caused continued pressure on transportation fuel markets, making it challenging to ensure consistent gasoline supply across the nation.

“Allowing the year-round sale of E15 in all parts of the country will significantly help to enhance supply and lower prices,” NATSO said. “If fuel retailers are allowed to sell E15, consumers mired by high prices will benefit from significant cost savings at the pump.”

EPA previously issued a similar waiver for the 2023 driving season. NATSO continues to advocate for legislation that would provide a permanent, national solution to year-round E15 sales.
