NATSO Files Amicus Brief in Case Involving Small Refinery Exemptions

Abstract:

NATSO on January 17 filed an amicus brief in a case related to small refinery exemptions before the Fifth Circuit Court of Appeals. NATSO requested a rehearing of the case following the Court’s November 2023 decision which suggested that Renewable Identification Number (RIN) costs are not passed on to retailers and ultimately consumers. In its brief, NATSO argued that the Court “misunderstood fuel and RIN markets, undercut the goals of the RFS, and distorted this country’s free-market economy,” and should thus grant a rehearing of the case.
