FMCSA Extends Hours-of-Service Waiver for Gasoline, Diesel Haulers

The Federal Motor Carrier Safety Administration (FMCSA) extended its waiver for Hours-of-Service (HOS) restrictions for haulers of gasoline, diesel, jet fuel, ethyl alcohol, and heating fuel including propane, natural gas, and heating oil until August 31, 2022. The May 27 announcement also explicitly added diesel exhaust fluid (DEF) to the list of covered fuels.

FMCSA added DEF to its list of covered fuels at the request of NATSO. NATSO met several times with Biden Administration officials at the Departments of Transportation and Energy urging an extension of the waiver and the inclusion of DEF.

The announcement amends an existing Hours-of-Service waiver for COVID-19 emergency response efforts. Following previous efforts from NATSO, the FMCSA clarified that all covered fuels (including gasoline and diesel) being hauled in the United States today are part of the ongoing COVID-19 emergency response efforts and are therefore covered by the waiver.
