Senate Committee Advances FY 2017 Transportation Funding With HOS Fix
The Senate Appropriations Committee voted 30-0 April 21 to advance a $56 billion fiscal 2017 transportation funding bill that contains a potential fix to 2015 legislation that omitted key technical language required to keep the 34-hour restart provision of the Hours-of-Service Rule in effect pending the results of a Congressionally mandated study.

Trucking Policy Update
Representatives from the trucking industry as well as the Federal Motor Carrier Safety Administration (FMCSA) engaged in a “roundtable” discussion April 13 with the House Transportation Committee to discuss the trucking-related provisions in the long-term Highway Bill that Congress recently passed (known as the FAST Act).

Industry Tackles Hours-of-Service Issues
Congress currently is negotiating two provisions related to truck driver hours-of-service requirements.
The first involves the omission of technical language in the fiscal 2016 funding law that essentially would eliminate the 34-hour restart provision of the Hours-of-Service Rule if a congressionally mandated study of the restart provision fails to show safety benefits.
The second relates to states’ authority to impose mandatory rest and meal breaks on top of federal hours-of-service regulations.

FMCSA Concludes Data Collection for HOS Restart Study
The Federal Motor Carrier Safety Administration (FMCSA) said Oct. 1 that the agency has finished collecting data for its study of the hours-of-service restart provision and that it expects to issue a final report to Congress by year’s end.

34-Hour Restart Could Take Effect as Early as Sept. 30
The suspended 34-hour restart provision of the truck driver Hours-of-Service rule could be reinstated on Sept. 30 when the annual spending bill that included the suspension runs out. If the current stay of enforcement is removed, truck drivers again would be forced to include two 1 a.m. to 5 a.m. periods during the use of a 34-hour restart and be limited to using the restart just once a week.
