12-06-2017 by NATSO International Trade Commission Moves Closer to Imposing Duties on Biodiesel Imports

The U.S. International Trade Commission on Dec. 5 made a final finding that biodiesel imports from Argentina and Indonesia harm U.S. producers. The decision, coupled with last month’s final countervailing duties determination by the Department of Commerce, paves the way for final countervailing duties orders by the end of December. NATSO disagrees with the outcome, preferring free trade policies, and maintains that limiting fuel marketers’ access to supply from overseas will raise retail fuel prices. The decision does, however, obviate the need for Congress to convert the biodiesel tax credit from a blender credit to a producer credit, as this change was designed to limit imports in the first place.

11-02-2017 by NATSO EPA Sends 2018 RFS Proposal to OMB for Review

The Environmental Protection Agency (EPA) on Nov. 1 submitted its proposed rule for the 2018 Renewable Fuel Standard (RFS) renewable volume obligations — and 2019 obligations for biomass-based diesel — to the White House Office of Management and Budget (OMB) for interagency review. This marks the final step before the proposal is published in the Federal Register and open for public comment.

NATSO and a diverse group of biodiesel producers, fuel retailers and trucking interests representing every segment of the biodiesel supply chain sent a letter the Senate Finance Committee and House Ways and Means Committee on Oct. 31 in support of extending and phasing out the biodiesel blenders’ tax credit, and outlining their opposition to efforts to shift the credit to a producers’ credit as the tax-writing committees consider tax reform legislation.

10-25-2017 by NATSO Commerce Announces Preliminary Dumping Determination on Biodiesel Imports from Argentina and Indonesia

The U.S. Department of Commerce Oct. 23 announced a preliminary determination regarding biodiesel imports from Argentina and Indonesia, finding biodiesel is being dumped into the United States at below fair-market value. As a result, biodiesel importers will be required to pay cash deposits to the U.S. government on biodiesel imports from Argentina and Indonesia at a rate equal to the dumping margins.

09-27-2017 by NATSO EPA Considering Further Lowering Renewable Volume Mandates

The Environmental Protection Agency (EPA) on Sept. 26 announced that it was seeking public comment on a new approach to establishing renewable fuel mandates under the Renewable Fuel Standard (RFS): Only considering domestic production capacity. If EPA ultimately adopts this new approach, it will substantially lower retailers’ incentives to incorporate renewable fuels into their fuel supply. NATSO opposes this policy shift, and in comments it will file with the Agency will urge EPA to recognize that there is a global market for renewable fuels, such as biodiesel, and that the RFS should accommodate fuels regardless of where they are produced.

On May 18, the Environmental Protection Agency (EPA) released proposed renewable fuel mandates for 2017 under the Renewable Fuel Standard (RFS). The proposal also included a proposed 2018 volume mandate for biomass-based diesel (the 2017 biomass-based diesel number was finalized in late 2015).

On December 15, Congress unveiled a massive tax and spending package that will be debated over the remainder of this week. NATSO will be analyzing the thousands of pages of legislation in the coming days, but is pleased to report that some lawmakers’ efforts to convert the biodiesel blenders credit to a biodiesel producers credit has failed.
