Sen. Richard Durbin (D-IL) sent a letter on Oct. 16 to the U.S. Food and Drug Administration (FDA) urging the agency to publish a list of electronic nicotine delivery system (ENDS) products for which it has received a premarket tobacco product application (PMTA). Manufacturers of ENDS products were required to submit a PMTA to FDA by Sept. 9, 2020, to remain on the market. Without a publicly available list, retailers – including travel centers – will not know which products are legal for them to sell.

The Food and Drug Administration (FDA) is proposing to establish additional “traceability recordkeeping requirements” for manufacturers, processors, and others for foods the Agency has designated for inclusion on the Food Traceability List. This will apply to retail food establishments and the proposal expressly includes convenience stores and non-grocery stores.

The U.S. Food and Drug Administration’s (FDA’s) Center for Tobacco Policy issued a statement on Aug. 31 indicating the agency plans to publish a list of electronic nicotine delivery system (ENDS) products for which it has received a premarket tobacco product application (PMTA). FDA’s announcement is a win for the travel center industry. Without a publicly available list, retailers – including travel centers – will not know which products are legal for them to sell.

The Food and Drug Administration on Jan. 15 issued a statement clarifying for retailers that as of Dec. 20, 2019, it is illegal to sell tobacco products to anyone under the age of 21.
