Court Nixes NLRB Poster Rule

The U.S. Court of Appeals for the Fourth Circuit became the second appellate court to strike down the National Labor Relations Board's (NLRB) August 2011 regulation requiring businesses to post notices of an employee's right to unionize, finding that the NLRB exceeded its authority when it ordered businesses to display an 11-by-17-inch notice in a prominent location explaining the rights of workers to join a union and bargain collectively. Coalition: Governor Should Withdraw N.C. Tolling Application

North Carolina Gov. Pat McCrory should direct the state Department of Transportation to withdraw its application to toll Interstate 95 under a federal pilot program and put the tolling idea permanently to rest, Scott Aman, president and CEO of New Dixie Oil Corp., said in a recent op-ed in the "Fayetteville Observer," published June 5. Aman also serves on the board of the No Tolls I-95 Coalition. More

FERC Declines to Delay TEPPCO Halt of ULSD Shipments

The Federal Energy Regulatory Commission (FERC) has declined to intervene in Enterprise TEPPCO's decision to eliminate ULSD and jet fuel shipments in their pipeline effective July 1, 2013. In addition to NATSO and four other petroleum marketing associations, a wide range of interests participated in the protest, including airlines, trucking companies, associations, terminal operators and agricultural cooperative. Members of Congress and the Arkansas Attorney General also weighed in with the commission. More
