NATSO Files Comments With DOL Regarding Overtime

Abstract:

NATSO on Sept. 25 filed comments with the Department of Labor urging the agency to update the salary threshold such that employees below it clearly would not satisfy the duties test, and employees above it would still need to satisfy the current duties test in order to qualify for an exemption. NATSO said the Department should not make any other changes to the overtime regime, such as establishing multiple salary levels, automatically increasing salary thresholds without agency review and the opportunity for public comment, and changes to the duties test.
