FMCSA Amends Medical Exam Form Rules

The Federal Motor Carrier Safety Administration (FMCSA) amended its medical examination rules April 23, mandating that medical examiners performing physical exams of commercial drivers use a new medical exam report and submit exam results to the agency by midnight of the following day.

The rule, published April 23 in the Federal Register, requires certified medical examiners to use Medical Examination Report (MER) Form MCSA-5875 in place of the current MER form and to use form MCSA-5876 for the Medical Examiner’s Certificate.

Report results must be submitted to FMCSA by midnight local time of the next day following the exam. This includes the results of exams where the driver was found not to be qualified.

FMCSA said exam results must be reported for all commercial motor vehicle drivers who are required to be medically certified to operate in interstate commerce, not just those who hold or apply for a commercial learner’s permit or commercial driver’s license.

Exam results must be reported by completing a CMV Driver Medical Examination Results Form MCSA-5850 via the National Registry web account.

In May 2014, FMCSA established that only medical examiners listed on a newly created national registry may conduct driver physical exams and issue medical certificates for commercial drivers. That rule requires employers to verify that medical certificates presented by drivers were issued by a certified medical professional listed on the national registry.
