FDA Seeks to Have Cigarette Label Case Reheard

The federal government last week formally asked for a full court review of the U.S. Court of Appeals decision that struck down the Food and Drug Administration's (FDA) graphic labeling requirements for cigarette packages. A three-judge U.S. Court of Appeals panel in August struck down the law requiring the images, ruling that the FDA violated corporate speech rights. The D.C. Circuit now will decide whether or not to hear the case before the full court.
