Clean Diesel Challenges EPA, NHTSA Fuel Economy, GHG Emissions Standards

Clean diesel company Plant Oil Powered Diesel Fuel Systems Inc. (POP Diesel) recently filed two lawsuits challenging the Environmental Protection Agency (EPA) and Transportation Department's joint fuel economy greenhouse gas (GHG) emissions standards for passenger vehicles and heavy trucks.

The first lawsuit, filed in the U.S. Court of Appeals for the District of Columbia, challenges the agencies' denial of the company's petition to reconsider the combined fuel economy and emissions standards for medium- and heavy-duty trucks. The company argued in its petitions that the agencies had not considered vegetable oil-derived diesel fuel when it set the truck standards.

The second lawsuit challenges the Oct. 15 final rule that sets joint fuel economy and GHG emissions standards for model year 2017 through 2025 passenger vehicles. The rule requires vehicles to achieve an average of 54.5 miles per gallon by 2025 if the GHG reductions are achieved primarily through fuel economy improvements.

POP Diesel is the first company to file a challenge to the passenger vehicle rule. Automobile manufacturers and unions supported the nationwide standards.
