The U.S. District Court for the District of Columbia on May 15 heard oral arguments in the Coalition for a Democratic Workplace’s challenge to the National Labor Relations Board’s “ambush elections” rule.

CDW, of which NATSO is a member, filed a lawsuit in January to stop the NLRB from moving forward with its final elections rule, which dictates procedures for workplace elections that determine whether employees want to be represented by a union. The rule dramatically shortens the time frame for businesses to hold union elections to as little as 14 days.

The rule took effect April 14 after President Obama signed a memorandum of disapproval that effectively vetoed the Congressional Review Act resolution (S.J. Res. 8) that would have blocked the rule.

It is not yet known when the Court might issue a ruling in the case.
