House Approves Measure to Block Ambush Election Rule

The U.S. House of Representatives on March 19 voted 232 to 186 in favor of the Congressional Review Act Resolution to block the National Labor Relations Board’s “ambush” election rule. The President is expected to veto the measure, however, which passed the Senate 53-46 earlier this month.

The U.S. House of Representatives on March 19 voted 232 to 186 in favor of the Congressional Review Act resolution (S.J. Res. 8) to block the National Labor Relations Board’s “ambush” election rule.

The President is expected to veto the measure, however, which passed the Senate 53-46 earlier this month.

The Coalition for a Democratic Workplace (CDW), of which NATSO is a member, quickly issued a statement urging the President to side with legislators, employers and employees.

“While everything about the ambush elections bill has been driven by unilateral action from the administration, we are hopeful that a rare bicameral move will lead the President to side with legislators, employers, employees, and decades of precedent,” CDW said.

Under the Congressional Review Act, lawmakers can formally review and reject any agency rules. However, like a bill, the President can veto the resolution, requiring a congressional override to defeat a rule.

A veto override is considered unlikely, however, as both the Senate and House votes on the resolution fell short of two-thirds majority. 

CDW has been working to stop the NLRB from moving forward with its election rule, which dramatically shortens the time frame for businesses to hold union elections to as little as 14 days. The rule dictates procedures for workplace elections that determine whether employees want to be represented by a union.

The ambush election rule will go into effect April 14 unless a court or Congress blocks enforcement.

CDW has previously filed a federal lawsuit to block the ambush election rule.
